What the current law says
Under NRS 687B.352, an insurer that issues Medicare Supplement policies must offer a current policyholder an annual open enrollment period beginning on the first day of the policyholder’s birthday month and continuing for at least 60 days.
During that period, the person may purchase a Medicare Supplement policy available from the insurer in Nevada that has the same or lesser benefits. The statute limits certain underwriting actions during this period, including denying or conditioning issuance based on health status or claims experience.
What the rule does not automatically mean
- It does not mean every carrier or every plan letter is available to every applicant.
- It does not guarantee a lower premium.
- It does not create a right to move to a policy with greater benefits without underwriting.
- It does not replace other federal or state guaranteed-issue rights that may apply.
